In consideration of being permitted to participate in Training organized by Nighthawk Alliance LLC, I, the undersigned, hereby voluntarily and willingly agree to release, discharge, indemnify, and hold harmless Nighthawk Alliance LLC, its agents, employees, volunteers, officers, and directors (collectively referred to as the "Released Parties") from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses (including attorney's fees) whatsoever, whether known or unknown, anticipated or unanticipated, arising out of or related to my participation in any Training activities.
I acknowledge and understand that the Training involves inherent risks, including, but not limited to, the risk of serious bodily harm, injury, or death. These risks may arise from the nature of the training itself, the use of equipment, physical exertion, environmental conditions, accidents, slips, falls, or any other hazards associated with any training activities provided by Nighthawk Alliance LLC.
I further acknowledge and understand that Nighthawk Alliance LLC has taken reasonable steps to provide a safe environment for all Training activities. However, I recognize that there are factors beyond their control, and accidents or incidents may occur despite their best efforts.
I expressly waive and release any and all claims, actions, or causes of action that I have or may have in the future against the Released Parties for any injury, illness, loss, damage, or harm that may occur as a result of my participation in the Training, including claims arising from my own misunderstanding, misinterpretation, or misuse of the training provided, or from the negligence or fault of the Released Parties.
I understand and acknowledge that Nighthawk Alliance LLC is not providing legal advice, and that laws and regulations continue to change and vary by location. When and where required, Nighthawk Alliance LLC adheres to the prescribed training standards set by local, state, federal, or certifying bodies. These requirements may or may not represent the beliefs or goals of Nighthawk Alliance.
Additionally, I hereby grant permission to Nighthawk Alliance LLC and its authorized representatives to record my likeness via video, audio, and photographs during the Training. I understand and agree that the recordings may be used for promotional, educational, or other purposes by Nighthawk Alliance LLC, without any claims to compensation or ownership of the recorded materials. I acknowledge that Nighthawk Alliance LLC
is the sole owner of the recorded materials and has the right to edit, reproduce, distribute, and publicly display them in any format or media now known or hereafter developed, without further consent from or payment to me.
